Who we are#
Marginal ("Marginal", "we", "us") is operated by Jithin Lal K, an individual, trading as Marginal. When you use Marginal, you are contracting with Jithin Lal K. You can reach us any time at jithin@marginalhq.com.
Acceptance of these terms#
By creating an account or using Marginal, you agree to these terms. If you use Marginal on behalf of a company, you confirm you have authority to bind that company, and "you" means that company. If you don't agree with these terms, don't use the service. Continued use of the service after changes to these terms means you accept the updated terms.
The service#
Marginal is a cost-tracking service for AI features: you send us usage events (model, provider, token counts, and fields you define) and we price, store, and analyze them. You are responsible for your account credentials and for the API keys issued to your projects, and for everything done with them. Keep them secret; tell us immediately if you believe one is compromised.
Acceptable use#
You must not misuse the service. In particular, you must not:
- use it for any unlawful purpose or in violation of any applicable law;
- engage in fraud, spam, or deceptive practices through the service;
- infringe anyone's intellectual property rights;
- interfere with the service's security or integrity — including distributing malware, probing or scanning for vulnerabilities without permission, scraping, or disrupting the service or other users;
- resell or provide the service to third parties as your own, or misrepresent your affiliation with Marginal.
Your data and our IP#
You retain all rights to the data you send to Marginal. You grant us the license needed to store, process, and display that data back to you — that's the service. We retain all ownership of the service itself and its intellectual property, including the software, documentation, and Marginal branding. The Marginal SDKs are published under their own open-source licenses.
Plans, billing, and payments#
Paid subscriptions are billed through our payments partner. Our order process is conducted by our online reseller and Merchant of Record, Paddle, who handles payment, billing, taxes, and payment-related customer service. Payment terms, renewals, cancellations, fees, and taxes are governed by Paddle's buyer terms alongside these terms.
Subscriptions renew automatically each billing period (monthly or annually) until canceled. Each plan has usage limits described on our pricing page; we may change plan pricing or limits with notice, taking effect at your next renewal. The free plan is provided as-is and may be changed at any time.
Cancellation and refunds#
You can cancel your subscription at any time from the billing portal (Account → Manage billing). Cancellation takes effect at the end of the current billing period, and you keep access until then. Refunds are handled per our Refund Policy.
Service level#
Marginal is provided "as is" and "as available". We work hard to keep it fast and reliable, but we do not guarantee that the service will be uninterrupted, error-free, or that any defect will be corrected. To the maximum extent permitted by law, we disclaim all implied warranties, and our total liability for any claim arising out of the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential damages, or for loss of data caused by events outside our reasonable control.
Suspension and termination#
We may suspend or terminate your access if you materially breach these terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our policies. Where reasonable we'll warn you first. You may stop using the service and delete your account at any time by contacting us. After termination we'll delete your data on request, as described in our Privacy Policy.
Changes to these terms#
We may update these terms from time to time. If a change is material, we'll make reasonable efforts to notify you (for example by email or an in-app notice) before it takes effect. The "Last updated" date above always reflects the current version.
Governing law#
These terms are governed by the laws of India, without regard to conflict of law principles.
